Terms of Service

The short version: Trekka lets you walk and hike real-world routes virtually using your step data. Use it safely, don't abuse it, and understand that it is not a medical or navigation tool. Purchases are handled by Apple and are subject to Apple's refund policies. If you delete your account, your data is gone for good; we cannot recover it.

1. Acceptance of Terms

By downloading, installing, or using Trekka ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms form a binding agreement between you and Parker Siroishka ("we", "us", "our"), the individual developer operating Trekka, based in Calgary, Alberta, Canada. Our Privacy Policy is incorporated into these Terms by reference.

These Terms apply to your use of the App on any Apple device. Additional terms imposed by Apple as the App Store distributor also apply; specifically, Apple's App Store Terms of Service. In the event of a conflict between these Terms and Apple's terms, Apple's terms govern with respect to the App Store relationship.

2. Eligibility

You may use the App only if:

  • You are at least 13 years of age; and
  • You have the legal capacity to enter into a binding agreement in your jurisdiction; and
  • Your use complies with all applicable laws and regulations.

If you are between 13 and 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. The App is not directed at children under 13.

3. Your Account

Trekka does not use email addresses, passwords, or social logins. On first launch, the App generates a random anonymous identifier ("your account") stored in your iOS Keychain. If you have iCloud Keychain enabled, this identifier syncs across your Apple devices automatically.

Account responsibility

Your account is tied to your device's Keychain, not to any credentials we hold. You are responsible for:

  • Maintaining access to the devices and Apple ID associated with your account
  • All activity that occurs under your account

Account loss

If you erase your device, lose access to iCloud Keychain, or otherwise lose your anonymous identifier without having used the App's account-transfer flow, we have no way to identify or recover your account. All data linked to that identifier (including route progress, purchase unlock status, and shoe entries) will be inaccessible. We are not liable for data loss resulting from loss of Keychain access.

To help prevent this, we recommend keeping iCloud Keychain enabled on your primary device.

Account deletion

You may delete your account at any time from within the App. Deletion is immediate and permanent; all data linked to your anonymous identifier is removed from our servers and cannot be recovered. Your Apple purchase history and any refund eligibility are managed separately by Apple and are unaffected by account deletion.

4. The Service

Trekka is a virtual route-tracking app. It reads step count, walking/running distance, and flights climbed from Apple Health (with your permission) and maps that activity onto curated real-world routes. The App also provides a shoe-mileage tracker and related statistics.

We reserve the right to modify, add, suspend, or remove features or content at any time. Where a modification materially reduces the functionality available under a paid purchase, we will make reasonable efforts to communicate that change in advance.

Route data, distances, waypoints, and associated descriptions are provided for entertainment and motivational purposes. They are not a substitute for official trail maps, navigation software, or on-the-ground judgment. Do not rely on Trekka for actual navigation.

5. In-App Purchases

Trailhead Pass

The Trailhead Pass is a one-time in-app purchase that unlocks the full route library and any other content designated as premium at the time of purchase. Once unlocked, access to the content available at the time of your purchase is permanent for as long as your anonymous account exists.

Additional content

We may offer additional paid content in the future (such as route packs). Each such offering will be a separate purchase with its own clearly described scope. Purchasing the Trailhead Pass does not entitle you to future paid add-ons released after your purchase date.

Billing and refunds

All purchases are processed by Apple through the App Store. We do not handle payment information directly. Prices are set in your local currency by the App Store and may vary by region. All sales are subject to Apple's payment and refund terms. Refund requests must be directed to Apple; we cannot issue refunds directly.

Restore purchases

If you reinstall the App or set up a new device, use the "Restore Purchases" function within the App to re-validate your Trailhead Pass with Apple's servers. You must use the same Apple ID used at the time of purchase.

Effect of account deletion on purchases

Deleting your account removes your user record and all associated data, including your server-side premium status. Your Apple purchase history is retained by Apple regardless. You can restore your purchase on a new account using "Restore Purchases," provided you use the same Apple ID.

6. Apple Health & HealthKit

Trekka requests permission to read step count, walking/running distance, and flights climbed from Apple Health. Granting this permission is voluntary. The App will function without it, but route progress will not advance.

You may revoke this permission at any time in iOS Settings > Privacy & Security > Health > Trekka. Revoking permission stops future syncs immediately; historical totals already synced to our servers are retained until you delete your account.

Health data is used solely to calculate route progress and activity statistics within the App. It is never used for advertising, sold, or shared with third parties. See our Privacy Policy for full details.

7. Health & Safety Disclaimer

Trekka is not a medical device, health service, or fitness programme. The step counts, distances, and activity totals displayed in the App are derived from Apple Health data and are provided for motivational and entertainment purposes only.

Nothing in the App constitutes medical advice, diagnosis, or treatment. Do not use Trekka to make decisions about your health, fitness, or medical care. Before beginning or significantly changing a physical activity routine, consult a qualified healthcare professional.

You assume full responsibility for your physical safety during any real-world activity. We are not liable for injuries, accidents, or health events that occur during or in connection with your use of the App.

8. Acceptable Use

You agree not to:

  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Tamper with, spoof, or artificially inflate step counts, route progress, or purchase status sent to our servers
  • Use automated means (bots, scripts, emulators) to interact with the App or our backend API
  • Attempt to gain unauthorised access to our servers, databases, or other users' data
  • Use the App in any way that violates applicable law or these Terms

We reserve the right to suspend or terminate access for any account we reasonably believe is engaged in the above conduct, without prior notice.

9. Intellectual Property

The App, including its design, code, route content, copy, icons, and graphics, is owned by Parker Siroishka and protected by Canadian and international copyright, trademark, and other intellectual property laws. These Terms do not transfer any ownership rights to you.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, solely for personal, non-commercial purposes, in accordance with these Terms and Apple's App Store rules.

Route names that correspond to real-world trails, parks, or geographic features are the property of their respective owners. Use of such names in the App is descriptive and does not imply affiliation with or endorsement by those owners.

10. Third-Party Content & Credits

Route imagery

Some images displayed in the App are sourced from third-party providers, including Unsplash and Wikimedia Commons. Images from these platforms are used under their respective licences, which generally permit use without mandatory attribution. Where a specific image requires attribution under a Creative Commons or other open licence, that credit is provided within the App on the Credits page.

If you believe an image has been used without proper credit, please contact us at contacttrekka@gmail.com and we will correct it promptly.

Route and race names

Some routes in the App reference the names of real-world trails, races, and sporting events (for example, well-known ultramarathons or road races). These names are used for descriptive and informational purposes only — to identify the geographic route being represented. Trekka is not affiliated with, endorsed by, or in partnership with any race organisation, governing body, or event organiser. All trademarks and registered names remain the property of their respective owners.

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that:

  • The App will be uninterrupted, error-free, or available at all times
  • Step counts, distances, or progress calculations will be perfectly accurate; these depend on Apple Health data, which itself depends on your device hardware and settings
  • Route data accurately reflects current real-world trail conditions, distances, or accessibility

12. Limitation of Liability

To the fullest extent permitted by applicable law, Parker Siroishka shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to:

  • Loss of data, including route progress or purchase records
  • Inaccurate step counts or activity totals
  • Injuries or health events occurring during physical activity
  • Service interruptions or App unavailability

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability is limited to the maximum extent permitted by law. In no event shall our total liability to you exceed the amount you paid for the App in the twelve months preceding the claim.

13. Third-Party Services

The App integrates with Apple services (HealthKit, StoreKit 2, iCloud Keychain) and our backend runs on Railway. These third parties have their own terms and privacy policies. We are not responsible for the practices or availability of third-party services.

The App does not contain links to third-party websites or services beyond what is described in our Privacy Policy and linked in the Credits page. We are not responsible for the content or availability of third-party websites or services.

14. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the App, with reasonable notice where practicable.

On termination, Sections 7 (Health & Safety Disclaimer), 9 (Intellectual Property), 10 (Third-Party Content & Credits), 11 (Disclaimer of Warranties), 12 (Limitation of Liability), and 15 (Governing Law) survive.

15. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved informally by contacting us at contacttrekka@gmail.com. If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada.

If you are a consumer in the EU or UK, nothing in this section limits any mandatory rights you have under applicable consumer protection law in your country of residence.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. For material changes such as changes to payment terms, significant new restrictions, or changes to how purchases work, we will provide notice within the App or through App Store update notes. Continued use of the App after updated Terms take effect constitutes acceptance of the revised Terms.
